AI Advertising Disclosure Act
Summary:
• The "AI Advertising Disclosure Act" requires operators of AI tools with more than 50,000 monthly active users to clearly disclose when AI-generated responses are influenced by commercial arrangements, such as paid promotions, affiliate links, or sponsored content.
• Covered entities are prohibited from instructing AI systems to deny being AI or deny commercial relationships when directly asked, using design patterns that obscure disclosures, or presenting sponsored content as organic AI reasoning.
• Enforcement is shared among the FTC, state attorneys general, and private individuals, with private plaintiffs able to recover up to $1,000 per violation (or actual damages, whichever is greater), tripled for willful violations.
