Smart Meter Data Privacy Protection Act
Summary:
• The "Smart Meter Data Privacy Protection Act" prohibits covered utilities (State regulated electric utilities not wholly owned by U.S. persons) from using, selling, licensing, or monetizing electric consumers' smart meter data except for authorized operational purposes such as billing, outage management, grid reliability, regulatory compliance, and consumer-authorized demand response programs.
• Covered utilities that violate the data use prohibition must credit the affected consumer's bill three times the revenue attributable to the violation, and may not recover that cost from any consumers they serve.
• The FTC enforces the law, state attorneys general may bring civil actions on behalf of residents, and the Act establishes a federal baseline that does not preempt stronger state privacy protections.
