Freedom of Association in Higher Education Act of 2026
Summary:
• Amends the Higher Education Act of 1965 to prohibit institutions of higher education receiving federal funds from taking adverse actions against students or single-sex social organizations (such as fraternities and sororities) based solely on those organizations limiting membership to one sex.
• Students at covered institutions have the right to form, join, participate in, or lead single-sex social organizations, and institutions cannot require students to waive these protections or disclose membership as a condition of enrollment.
• The bill defines "sex" strictly as biological sex (male or female) based on reproductive systems, and defines covered single-sex social organizations to include tax-exempt fraternities/sororities and historically single-sex social clubs consisting primarily of students or alumni.
