Small Business Payment for Performance Act of 2026
Summary:
• Amends the Small Business Act to require federal agencies to provide an interim partial payment of at least 50% of the estimated additional costs when a small business contractor requests an equitable adjustment due to a contracting officer-directed change in a construction contract's terms.
• Requires small business contractors receiving these interim partial payments to pass through the appropriate portions to first-tier subcontractors, who must in turn pay any lower-tier subcontractors their appropriate share.
• The Small Business Administration must implement these requirements by the first day of the first full fiscal year after enactment, or by October 1, 2027, whichever comes first.
